True HumVee Tours Terms and Conditions
Terms and conditions of travel on True Humvee Tours military HMMWV’s.
Passengers on HMMWV tour are subject to natural elements and environments. Possible hazards include but are not limited to excessive heat, excessive cold, wind, dust, rain, hail, snow, sleet, sand storms, poisonous insects, venomous reptiles, spiny plants, aggressive predators, landslides and other possible detrimental scenarios. It is strongly recommended passengers familiarize themselves with the areas they will be travelling in and research previous and future weather patterns prior to booking a tour. Passengers should note that HMMWV tours involve a higher than normal risk.
High Mobility Multipurpose Wheeled Vehicles, HMMWV, are 1-1/4-ton troop/cargo carriers and have a stiff suspension. Although operators make every effort to travel as smoothly as possible it is possible the passengers will experience jarring bumps, swaying and shaking during the tour. Passengers with back problems, who are pregnant or who have suffered previous injuries may experience travails detrimental to their condition.
Itineraries are correct at the time of booking per website selection and/or scheduling agreed upon for custom tours. Cancellations within 48 hours of scheduled departure and/or no shows will not be eligible for refunds.
True Humvee Tours reserves the right to refuse to carry passengers whose behavior is detrimental to the safety and/or enjoyment of other passengers. By travelling with True Humvee Tours, passengers agree to accept the authority of the operator/guide and accept their decisions. Our staff are entitled to a safe working environment and our passengers to great experience. Any threats to safety, being physical or verbal, or inappropriate behavior may result in removal from the tour. If an operator or guide requires a guest to leave the tour, no refunds will be given and the former passenger will be responsible for their own travel costs and arrangements from that point.
Passengers are restricted from the use of tobacco products, e-cigarettes, medical marijuana, alcoholic beverages, illegal drugs and any other substance that poses a threat to the safety and/or enjoyment of other passengers.
Passengers are prohibited from openly carrying firearms and/or edged weapons unless prior scheduling of special events allows them during those special events.
Children must be accompanied by an adequate number of responsible adults. Children who fall within Arizona State guidelines for child restraints must be provided those restraints by their accompanying adults and those restraints must be used during the full length of their tour.
All passengers accept that to participate in the tour requires a measure of physical fitness and health and it is the passenger’s obligation to ensure that he/she is medically fit to participate on these tours.
Personal Belongings and Vehicles
The passengers shall be responsible for all baggage and personal effects they have brought on the tour, and True Humvee Tours shall not be liable for any loss or damage to such belongings.
True Humvee Tours shall not be liable for loss, damage or theft of vehicles left at the rendezvous point of the tours.
Passengers are allowed one bag or backpack on tours.
True Humvee Tours reserves the right to use any photographs and/or videos taken during loading the HMMWVs, on the tour or unloading the HMMWVs for use in marketing or any advertising material and the client herby consents to such use. Passengers further agree that True Humvee Tours shall retain copyright over any such photographs and/or videos taken during loading, unloading or on the HMMWV tour and or used for marketing and, to the extent necessary, the passengers hereby assign copyright in such photographs and/or videos to True Humvee tours.
All photographs, images and text presented on True Humvee Tours website, fliers, brochures or any other marketing media is the soul property of True Humvee Tours. Any unauthorized use of these materials is prohibited.
Responsible Persons by Proxy
Any person having read, understood and accepted these terms and conditions in the process of booking a tour or tours for himself/herself and others is, by proxy, responsible for those passenger’s well-being. Those passengers having been booked for a tour or tours that have not read, understood and accepted these terms and conditions are inextricably subject to these terms and conditions, by proxy, through the person that booked the tour or tours for the passenger/s.
Unforeseen circumstances including but not limited to mechanical breakdowns, weather anomalies and other reasons beyond control of True Humvee Tours may cause delays, alterations or cancellations to the tour. True Humvee Tours shall not be held liable in any way for any possible occurrence or any consequence that which may arise because of such an occurrence.
Indemnification and Exclusion of Liability
Passengers accept that the tour is of an adventurous nature and involves an element of personal risk.
True Humvee Tours and its respective directors, officers, employees, representatives and agents shall not be liable for any loss or damage of whatsoever nature and whosoever arising, (including, but not limited to, the passenger’s or any person’s injury or death, or any loss of or damage to the passenger’s or any other person’s property) which the passenger or any such other person may occur or suffer as a result of or arising from the passengers participation in the tour and any other activities undertaken on or during the tour, and the passenger irrevocably and forever releases and discharges True Humvee Tours and it’s respective directors, officers, employees, representatives and agents from any and all such liability.
The passengers furthermore indemnify and hold True Humvee Tours and its respective officers, directors, employees, representatives and agents harmless from and against any land all loss, damage, actions, proceedings, claims, demands and other legal costs and expenses (including legal costs on an attorney and own client scale) of whatsoever arising (including, but not limited to, the passenger or any other person’s injury or death, or any loss of or damage to the passengers or any other person’s property) which the passenger or any such other person may occur or suffer as a result of or arising from the passenger’s participation in the tour and any other activities undertaken on or during the tour.
